New York Lottery+ Procedures

A. Overview of the New York Lottery+ Program

The New York Lottery+ Program (the "Program") is a Promotion and Second Chance Lottery program sponsored by the  New York State Gaming Commission (“Commission”), operator of the New York Lottery program through which individuals (“Participants”) can submit eligible tickets by visiting http://nylottery.ny.gov (the “Website”) or the Official New York Lottery mobile application (the “App”) to gain entries into second chance draws and promotions or to collect NYL+ Plus Points (“Points”) that can be redeemed to participate in promotions, games, and draws (“Promotions”). The Program is administered by Marcus Thomas, LLC, as a vendor and/or subcontractor of MRM, LLC, the contracted Strategic Digital Partner of the Commission.

B. Participation in the Program
  1. The Program is void where prohibited by law. Participants must be at least 18 years of age or older.
  2. The following individuals are NOT eligible to participate in the Program: (a) employees of Marcus Thomas, LLC; (b) employees of the Commission; (c) employees of the Commission’s affiliates, subsidiaries, partners, advertising and promotion agencies; (d) employees of any other person or entity involved in the development, administration, or execution of the Program; and (e) the spouse, child, brother, sister or parent residing as a member of the same household as persons set forth in items (a) through (d) above; (f) a self-excluded person pursuant to 9 NYCRR Part 5402.
  3. By participating in the Program, each Participant acknowledges and agrees that they have read and fully understand the Program Procedures, the General Guidelines, and the Terms & Conditions of the Website (the “Terms”), agree to abide by the same, and represent that Participant meets the eligibility requirements set forth therein. Participation in the Program is subject to these Program Procedures, General Guidelines, and the Terms, as well as policies and procedures that the Commission may adopt or modify from time to time. Should terms within these documents contradict, the interpretation that favors the Commission shall take priority. Those who do not comply with the Program Procedures, General Guidelines, and the Terms, or who engage in any conduct detrimental to the Commission or any misrepresentation or fraudulent activities in connection with the Program may have their Account terminated, be prohibited from participating in the Program, and may be subject to any rights or remedies available to the Commission in law or equity, as well as forfeiture of Points accrued to date and any other benefits earned in connection therewith, in the Commission's sole discretion.
  4. To participate, individuals must register at the Website, through the App found in “The App Store™, or “the Google Play store” and expressly accept these Program Procedures, General Guidelines, and the Terms. Participants will receive a registration confirmation by email. Each Participant is solely responsible for the accuracy of any email address provided in their registration. To learn how Marcus Thomas, LLC and the New York Lottery will use the personal information collected in connection with the Program, read the New York Lottery Privacy Policy contained within the Terms.
  5. When registering for the Program, individuals must go through an identification verification process that may include, but is not limited to, submitting the last four digits of an individual’s Social Security Number (SSN), submitting a clear picture of the individual’s valid photo identification and submitting a clear self-portrait taken by a mobile device or webcam. By registering for an account, you consent to the Commission’s use of any age-verification and identity-verification technology or method the Commission deems appropriate.
C. Modification and Termination of the Program
  1. By participating in the Program, Participants hereby agree that the Commission may modify, without limitation, any of the Terms, General Guidelines, and these Program Procedures governing the Program at any time, with or without notice, even though these changes may affect a Participant's ability to use accumulated Points.
  2. A Participant's continued participation in the Program constitutes acceptance of any changes to these Program Procedures and the Terms.
  3. The period of time the Program will be active (“Program Period”) will begin on September 2, 2025 and will be in effect until an end date for the Program is announced by the Commission on the Website and App.
D. Collecting Points
  1. Registration. To enroll in the Program, a Participant must click on the "Register" button on the Website and follow the onscreen instructions to create a New York Lottery account ("Account") or log-in using an existing Account. To create an Account, an individual must have a unique and valid e-mail address, and must complete the required steps to validate their identity. Each registration is limited to one Account per person and per e-mail address, regardless of whether more than one person uses the same e-mail address. The person who is the authorized e-mail account holder of the e-mail address entered when registering (and who otherwise meets the eligibility criteria) will be deemed the Participant, and such email address cannot be used by another person to register a different Account. Once a Participant registers their existing Account or registers for a new Account, they will be enrolled in the Program. The number of Points collected by such Participant will be recorded and tracked in the Participant’s Account.
  2. Activity Points. Participants will be able to earn Points by participating in pre-defined activities. Activities and correlated Points earned can be found in the “MY NYL+” section of the Website, accessible to authenticated users.
  3. Unique Codes. Each Scratch-off Game ticket has a 14-digit serial number which appears on the back of the ticket and a 14-digit SCRATCH TO CASH number which appears under the scratch-off portion of the ticket. Each Draw Game ticket contains an 18-digit numerical code which appears on the lower front center of the ticket. Codes can be entered manually on the Website or in the App, or by scanning the associated bar code using “Ticket Check+” in the App. For each set of unique codes entered from a single Scratch-off Game ticket and/or Draw Game ticket, Participants will automatically receive Points corresponding to the codes entered. Some codes may be eligible for a direct entry into special promotions, in which case Participants must decide at the time of entry between receiving that entry or receiving Points. Participants will receive the number of Points for each ticket purchased and for which the codes are recorded on the Website based on guidelines provided for each promotion offered during the Program Period. Scratch-off and Draw Game tickets will earn Points on a 1:1 ratio meaning a $5 ticket will result in five Points, and a $1 ticket will result in one Point. During promotional periods, bonus Points may be awarded for entries. The Commission reserves the right to change the number of Points awarded for tickets purchased at any time during the Program, and the right to change, add, or remove the methods by which Participants can collect Points.
  4. Participant Accounts. The Commission will attempt to credit Participant Accounts with Points on a timely basis. However, each Participant will have the responsibility of ensuring that the Participant’s Points are properly credited. Any claim for Points not credited accurately must be received by the Commission within five (5) days of the date Participant claims the Points should have accrued. The Commission shall have no liability for any printing, production, typographical, mechanical, or other errors in the Points summaries or Accounts. The Commission reserves the right to invalidate Points from an Account if it determines that such Points were improperly credited to such Account or obtained fraudulently. The Commission reserves the right to require proof of accrual of Points and the Commission reserves the right to delay the processing or use of any Points without notice to Participants, to ensure compliance with these Program Procedures. Participants are responsible for maintaining the confidentiality of their Accounts and passwords and for restricting access to activity on their Account, and Participants agree to accept responsibility for all activities that occur under their respective Accounts.
  5. Illegible Codes. If a Participant cannot read a code or a code is destroyed when scratching off a ticket, Participant must send an email to Customer Service using the Contact Us link in the Help Center on nylottery.ny.gov. Customer Service will provide Participant with instructions on how to proceed. The Commission may require proof of illegible codes, not limited to submission of the tickets to the Commission in support of all claims related to damaged codes.
  6. No Cash Value or Transferability. Points do not constitute property, do not entitle a Participant a vested right or interest and have no cash value. As such, Points are not redeemable for cash, transferable or assignable for any reason, and are not transferable upon death, as part of a domestic relations matter, or otherwise by operation of law. The sale or gifting of Points is strictly prohibited. Any Points remaining in a Participant’s Account when an Account is closed by the registrant or by the Commission, or at the end of the Program Period, will be cancelled without compensation or other benefit. There shall be no carry over or transfer of Points to other Commission programs, or extensions of the Program beyond the Program Period, unless otherwise determined by the Commission in its sole and absolute discretion. Points provided under the Program may be used only for participation in the Program.
  7. Ticket eligibility. If a Participant disputes the Program’s rejection of a ticket’s codes during the Program Period, the Commission reserves the right to require proof of the Participant’s basis for a claim of an eligible ticket, including, but not limited to, the physical ticket that includes the unique codes in section D.3, above.  The Commission’s decisions regarding the awarding of Points and/or the ineligibility of a ticket are binding. Validated codes that are subsequently determined by the Commission to be invalid for any reason are subject to disqualification and the corresponding Points will be removed from the Participant’s Account to which the invalid Points were credited.
E. Use of Points
  1. A Participant may visit the Website or App to use Points for entries/plays in available Program draws, promotions and games during the Program Period.
  2. To use Points, a Participant clicks on the "Promotions" tab on the Website or App and follows the links and instructions to browse through available promotions. Once Participant has located a promotion to enter/play, Points can be redeemed by clicking on the link for that particular promotion and subsequently clicking to confirm the use of Points. Participant will receive confirmation of receiving an entry into the promotion and the associated Account shall have Points deducted.
  3. The Commission reserves the right to modify the list of promotions available, as well as their corresponding Point values, at any time for any reason.
  4. The Commission reserves the right to substitute prizes for those of equal or greater value. Cash will not be awarded in lieu of merchandise prizes, unless otherwise stated in the official guidelines of an individual Promotion.
  5. Prizes may be subject to offsets and tax withholdings. The Commission shall pay offsets from prize amounts, and will withhold required applicable minimum taxes from, and issue required withholding forms for taxable prize payment amounts to winners as required by law. Prizes shall not be issued to any winner who is on the Commission’s Voluntary Self-Exclusion list during a relevant promotional period and/or at the time a prize is scheduled to be awarded.
  6. The total number of Points a Participant can use is the number of Points available in the Participant’s Account.
  7. Usage of Points is final and the Points used will be deducted immediately from the Participant's Account.
F. General Terms and Conditions
  1. The Commission reserves the right to suspend or terminate the eligibility of any person who uses, or, in the case of suspension, is suspected of using, the Program in a manner inconsistent with these Program Procedures, General Guidelines, the Terms, or any federal or state laws. In addition to suspension or termination of Program eligibility, the Commission shall have the right to take appropriate administrative and/or legal action, including referral for criminal prosecution, as it deems necessary in its sole discretion.
  2. Any attempt by any person to undermine the legitimate operation of the Program may be a violation of law, and, should such an attempt be made, regardless of whether such attempt is successful, The Commission reserves the right to seek prosecution of, and damages from, any such person to the fullest extent permitted by law.
  3. The Commission’s failure to enforce any of the Program Procedures, General Guidelines, and the Terms shall not constitute a waiver of that, or any other, provision of the same.
  4. The Program is provided to individuals only. Corporations, associations, including school organizations, or other groups may not participate in the Program.
  5. All questions or disputes regarding the Program or a Participant’s compliance with the Program Procedures, General Guidelines, and the Terms will be resolved by the Commission in its sole discretion.
  6. Neither the Commission nor Marcus Thomas, LLC is responsible for any incorrect or inaccurate information supplied by Participants while participating in the Program.
  7. Participants are responsible for the payment of all taxes which may result from participation in the Program.
  8. Participants are responsible for maintaining updated contact information in the “My Profile” area of the Website. The information provided is to include legal name, current valid address, email address and phone numbers.
  9. The Commission reserves the right to request valid identification from participants, including but not limited to, a notarized copy of valid state or federal government issued identification.
  10. The Program is subject to all applicable laws.
G. Limitation of Liability
  1. Marcus Thomas, LLC, the Commission, and their respective parent companies, affiliates, subsidiaries, and promotional and advertising agencies are not responsible for any printing or computer error, omission, interruption, irregularity, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alteration of Program materials or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of Program information due to technical problems or traffic congestion on the internet, at any website or any combination thereof. If online access is temporarily corrupted and suspended, notice of such will be provided on the Website and the App.
  2. By participating in the Program, each Participant accepts all responsibility for, and hereby releases and agrees to defend, indemnify, and hold harmless Marcus Thomas, LLC, the Commission and their respective parent companies, subsidiaries, affiliates, agents, promotion and advertising agencies, franchisees, and each of their respective officers, directors, Commissioners, employees, members, and successors, assigns, and service providers from and against any claims, liabilities, damages, or expenses that may arise from actions taken by such Participant and/or Participant’s participation in the Program, or for any harm or injury caused by any third party.
  3. Under no circumstances, including, but not limited to, negligence, shall Marcus Thomas, LLC, the Commission, and their respective officers, directors, commissioners, employees, members, agents, franchisees, successors, assigns, and service providers be liable for any direct, indirect, incidental, special or consequential damages arising out of a Participant’s participation in the Program even if any or all of the foregoing or any of their authorized representatives have been advised of the possibility of such damages.
  4. By participating in the Program, a Participant waives any and all rights to bring any complaint or action related to any aspect of participation beyond one year after the first occurrence of the aspect of participation upon which the complaint or action is based.
  5. Other than as specifically set forth in these Procedures, the Program shall be governed by the laws of the State of New York and shall be interpreted according to New York State law. All disputes arising as related to the Program shall be brought exclusively in the appropriate court of the State of New York. By registering, a Participant waives access to any other court or forum that may have concurrent jurisdiction within or outside New York State to hear or resolve any such dispute.
  6. Marcus Thomas, LLC, the Commission and their respective officers, directors, Commissioners, employees, members, agents, franchisees, successors, assigns, and service providers, are not responsible for any products or services offered on the Website. TO THE FULLEST EXTENT ALLOWABLE BY LAW, MARCUS THOMAS, LLC AND THE COMMISSION SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES OBTAINED THROUGH THE PROGRAM, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
  7. The Commission’s decisions related to eligibility, Points, compliance, prizes, payments, and interpretation of Program Procedures, General Guidelines, and/or Terms related to the Program shall be final and binding.
  8. If any provision of these Program Procedures, General Guidelines, and/or Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder, that will otherwise remain in full force and effect.
H. Account Deletion
  1. To delete an Account, a Participant must contact customer service via email at gam.sm.NYLRegistration@gaming.ny.gov. When a Participant deletes their Account, the following information will be permanently deleted: name, address, email address, phone number, Points earned; Points used; entries; and all other transactional information.
  2. Participant will no longer have access to the Account and will not be able to retrieve any unused points, lottery coupons, or other prizes distributed through the Account.
  3. Once an Account has been deleted, Participant will not be eligible to win any second chance promotions, draws, or other offerings that were entered but not completed prior to Account deletion. Any current promotion entries associated with the account will be cancelled.
  4. If Participant wishes to create a new Account after deleting a previous Account, no previously-deleted information can be recovered from the previous Account, and Participant will be required to complete the identification verification process anew.
